Deposits and Refunds Policy
Forfeiture of Deposits
All monies paid as a deposit shall be forfeited, and Pro Web Design shall be released from any prior commitments and/or contractual obligations, unless a written agreement to the contrary has been executed by all parties, under the following circumstances:
a. The client cancels the project after Pro Web Design has commenced development at any stage or phase;
b. The project is abandoned for a period exceeding 60 (sixty) natural days without written or verbal communication from the client via any medium to postpone or delay its completion;
c. Pro Web Design is unable to complete the project due to errors, failures, or unavailability of services provided by third-party companies, including but not limited to web hosting services.Refund of Deposits
All monies paid as a deposit shall be refunded to the client under the following circumstances:
a. Pro Web Design is unable to complete the project despite the client having fulfilled all necessary requirements as outlined in the agreement;
b. Pro Web Design is unable to rectify any errors identified within the scope of the 30 Days Publishing Policy criteria;
c. A written agreement explicitly stipulating a refund has been executed and signed by all parties involved.No Returns Policy
Due to the digital nature of all products and/or services provided by Pro Web Design, no returns shall be permitted under any circumstances.
This policy is in compliance with Section 44 of the South African Consumer Protection Act (CPA) No. 68 of 2008, which exempts digital content from the right to return goods if the supply of such content began with the consumer’s prior consent and acknowledgment that they forfeit their right to cancel once the performance of services has commenced. By engaging with Pro Web Design, the client acknowledges and agrees that all digital products and services are exempt from return or cancellation once development or delivery has initiated, unless otherwise expressly stipulated in a written agreement signed by all parties. This policy is binding and shall govern all transactions and agreements between the client and Pro Web Design under South African law.
